Orlando DUI Law

Under Orlando DUI Law, a person can be charged with driving under the influence (DUI) if he/she drives a motor vehicle while impaired by drugs and/or alcohol.  Additionally, an individual can also be charged with a second DUI offense if he/she drives a motor vehicle with a blood alcohol level of 0.08% or higher. 

Once a person a person is arrested for DUI, depending on the situation, he/she may be charged with either a misdemeanor or felony DUI offense.  Generally, if it is the person’s first offense relating to driving under the influence, or in some instance, if the person did not cause any third party or property damage, he/she will usually be charged with a misdemeanor rather than a felony.  However, if the person has prior DUI convictions or if the individual caused bodily harm to another person or extensive property damage, it is highly likely that the person will be charged with a felony offense.
